Customer/Carrier Contract Terms & Conditions

KELLOGG’S AUTO TRANSPORT, INC. WILL NOT BE LIABLE FOR THE FOLLOWING

1. Articles left in vehicles (we are not licensed for this service), nor damages done by burglary in attempting to steal

articles in vehicle.

2. No delivery time is guaranteed. ALL DELIVERY TIMES ARE ONLY AN ESTIMATE OF NORMAL DELIVERIES (DELAYS

MAY OCCUR).

3. No auto rental will be honored (for delays, damage, or accidents).

4. Damage caused by leaking fluids, battery acid, cooling systems, anti-freeze solution, industrial fallout or any material

from driver entering and exiting vehicle and/or damage resulting from acts of nature.

5. Damage that is unable to be detected due to vehicle’s dirty condition.

6. Auto that is in generally poor condition, damages too numerous to list, unable to inspect due to poor weather; shipped

“AS-IS.”

7. Damage caused by freezing of cooling system and/or batteries. Protection from freezing will be furnished by and at the

expense of the shipper.

8. Any damages to antennas or power systems for any reason.

9. DAMAGES TO VEHICLE CAUSED BY:

a) Vehicles that cannot be driven on or off transporter under its own power are not insured for any reason.

b) Vehicles with insufficient brakes, parking brakes and/or parking gear are not insured for any reason.

c) Service charge to jump-start or to tow on or off transporter. This will be charged to the shipper upon delivery of the

vehicle, at transportation cost.

10. We are not responsible for faulty craftsmanship due to manufacturing defects (e.g. defects in factory weld or tie downs) or

damage that results to a vehicle from tie downs breaking or tearing.

11. SHIPPER IS RESPONSIBLE FOR PREPARING VEHICLE FOR SHIPMENT. All loose parts, camper shell, fragile or

protruding accessories, low hanging spoilers antennas, etc. must be removed and or properly secured. Any part of

vehicle that falls off during transit is Shipper’s responsibility, including salvaged vehicles. Shipper is responsible for any

damages caused by said part (including foreign liquids) to any and ALL VEHICLES INVOLVED.

KELLOGG’S WILL NOT INSURE NOR BE LIABLE FOR THE FOLLOWING

12. Any mechanical function, including engine, transmission, rear end, motor, motor mount, drive trains, wiring system,

window motors, radio, stereo, power steering, air bag, brake cable or brake systems, engine tuning, vehicle

computerized systems, alignment of suspension, etc. (anything that is mechanical).

13. Any exhaust systems, muffler or tail pipe, or spoiler damage at all.

14. Stone chips or dings, chips in windows or glass, minor dents and scratches that can be buffed out or touched up by

paint, rubs or scuffs on tires, wheels, and wire covers.

15. Any convertible tops that are loose, torn, or have extensive wear.

16. Kellogg's Auto Transport, Inc. will call shipper prior to delivery. It is the Shipper’s responsibility to meet the driver at any

specified time or place.

Claims must be made in writing within fifteen (15) days of delivery. Claims must include pictures of specific damages claimed. Mail claim to:

All claims, subrogation, litigation, or legal action must have right of venue in County of Sacramento, State of California. Shipper agrees that his insurance company has the primary responsibility under Shipper’s comprehensive coverage.

All claims are subject to a $250.00 deductible.
